Major changes to the handling of employers’ and public liability claims now in place

Effective from 1st August 2013, major reforms have been brought in which will affect the way Employers’ and Public Liability claims are handled. The good news is that if the new protocols work, the cost of claims will start to reduce.

What are the changes?

  • Insurers will be notified of personal injury claims valued between £1,000 - £25,000 by the claimant's solicitor via an online electronic portal. This is similar to the way motor injury claims are handled.

  • The introduction of the portal will mean that claims can be handled a lot quicker; helping to reduce the overall costs.

  • The deadline for clients or insurers to acknowledge claims has been slashed from 21 days to 24 hours.

  • Claims that are not acknowledged within 24 hours will be subject to a new predictive costs arrangement. So overall costs will be higher.

  • The deadline for insurers (on behalf of policy holders) to admit liability on EL claims has reduced from 90 days to 30 days and from 90 days to 40 days on PL claims.

What should I do differently?

  • Make sure any potential claims are notified promptly to your insurer.

  • In the event that you receive a claim direct from solicitors. All you need to do is acknowledge the CNF within 24 hours and advise the matter has been passed to your insurers.

  • Do not make any further comment on liability as your insurers will handle this on your behalf.

What type of claims will fall outside the new process?

  • Any claim where contributory negligence is alleged

  • EL disease claims where there is more than one defendant

  • Mesothelioma claims

  • Clinical negligence claims
